Actually, I don't know if they were trying to "steal" the name. My guess is that they came up with the same play on words, and just got attached to it. I've been in that position myself a few times... 

Like when some other guy beat me to the market with a "Squid Girl" comic, which was something I had in mind for a year or two, but didn't get cracking on. It was tempting to try to register a TM when I found out about that....

So it may have been a similar situation; where they had the idea for years and just didn't move on it early enough to establish a "Common Law trademark" (which you do by simply bring a product to market).

Anyway, it would have saved us both some money if they'd have thought up a new name...</description>
